The Proposed Permit Issue System

Low Doc:To ensure quality, certain types of personal defence device would be acquired through a regulated outlet such as a hunting and sporting store where self defence and victim avoidance training may also be offered.

At the time of purchase the applicant would complete the online application form sent electronically using the custom service portal at “Preservation of Life – Community Protection Australia” (POL-CPA).It is for this reason a $5 fee applies i.e. maintenance and improvement of the customer service portal.The above is referred to as a low doc permit application.

As to what types of personal protection devices would require a “low doc” application that is a matter for discussion and debate? Perhaps starting point is “pepper/mace spray”

Provided the store assistant has electronically affirmed the statement having verified the identity of the purchaser the permit issue would arrive in electronic format within five (5) minutes of being submitted.

A store assistant may only affirm a permit issue provided the statement given was valid within the specified criteria i.e. consistent with the information provided to them at their “permit assessor training” endorsed by POL-CPA .

A typical applicant’s statement meeting the criteria might read: “I am nurse that does shift work. Whilst we do have hospital security my car is often parked well away from the hospitals and I am aware that last year a nurse was sexual assaulted when walking to her car. I wish to carry this device (specified) in a public place in the event of being attacked.”

Another applicant’s statement might read: “I am a school teacher in a remote area where hunting dogs have been known to roam the streets. Last year an man who was walking in the park was attacked by two dogs. I walk from the school to my home and I wish to carry pepper spray (specified type and model of device) in a public place in the event of being attacked by dogs.”

The statement of dangerous dogs is of particular note (See below the news report of the school teacher attacked by 2 dogs and had to be air lifted to Hosptial because of the serious nature of her injuries.

Low Doc with Review:The above application protocol would also be applicable to other personal protection devices that are considered to be a regulated weapon, however for which they have a greater potential to cause attacker incapacity i.e. pepper spray and hand held tasers.The greater the potential for incapacity the more attention that needs to be given to home or work based secure storage and who and why a person may be permitted to carry the device in a public place.As an example, “hand held tasers” the store assistant submits the information electronically however a permit may not be issued until a POL-CPA reviewer as seconded the application.This arrangement is referred too as “low doc with review”.

The permit is issued after a background check and other inquiries have been made and the findings are satisfactory. A fee of $50 would apply and the permit issue would be 5-years and non-transferrable. The reason for the fee is to maintain and improve the review system that requires integrating with other data-bases i.e. POL-CPA / POLICE.In some cases a tribunal hearing if the initial review finds something inconsistent in the history of the applicant.

A Review Tribunal of 3 people with a show cause notice issued to the police as an “invitation” to attend to voice any objections they have supported by relevant evidence.

It is to be noted that the POL-CPA is a statutory authority that administrates the “Preservation of Life – Community Protection Act 2022” which is a Commonwealth statute law applicable nation wide. In other words, a permit issue in one state or territory is valid in another state or territory provided the address of the applicable is updated with POL-CPA within 3 months of a change of address.

The Act would need to include this statement:

“When a firearms law of a State or Territory is in conflict with a Commonwealth law within the context of self-defence the latter shall prevail to the extent of the inconsistency”.

This paragraph would be supported by the principles outlined in the Magna Carta which have been ignored in the past. The hope is that politicians that support the principle of the Magna Carta will recognise the importance of placing “preservation of life” above all other laws.

Grand-Farther murdered in front of his children…

A grandfather has reportedly been left “brain dead” in hospital after he was bashed unconscious in front of his family on Christmas night by a gang of youths armed with baseball bats and metal bars.

The 54-year-old was bashed outside his home on Esther Crescent in Mooroolbark, just before 11pm, in an incident police believe may have involved as many as eight people.

The man’s brother-in-law, Mark, told 3AW the family was outside their home when they were attacked.

“They knocked my sister out, and had my niece – from what I understand – by the hair,” he said.

One of his family members, a 25-year-old woman, managed to lock herself inside the home with her two-month-old baby and a toddler, according to 3AW.

A gang of youths armed with baseball bats and metal bars were seen by a member of a registered security firm getting out of two cars. The security officer was at home having Christmas dinner when he noticed the vehicles screech outside in the street. He looked to see the men armed with baseball bats and iron bars jump his neighbour’s fence and run towards his neighbour’s family that were playing with children in the front yard of their house. Fearing that his neighbour’s life was in immediate grievous danger the security officer immediately went to his home safe and retrieved a registered 38 calibre revolver and his security firm’s issued identification card.

Note 1: The security firm is a not for profit security firm quality endorsed by “Preservation of Life – Community Protection Australia” a statutory authority administrating the “Community Protection Act 2022”.

Crossing the road the security officer yelled to the men who had knocked his neighbour to the ground and were kicking him to “stop”. Another man was seen punching a woman holding a child to the ground.

The gang of arm men turned and looked in the direction of the security officer.

One of men began to walk towards the security officer waving a baseball bat in a threatening manner. The security office held up his identification and pointing the revolver at the armed gang member with his finger along the trigger guard he shouted, “If you cross that road to attack me, I will shoot, do you understand I will shoot !”

The gang member stopped his approach and yelled to his other gang members something. The gang of men stopped their attacks upon the man and woman and ran to their cars and drove off. The security officer noted the registration numbers and advised the police that arrived on the scene about ten minutes after the gang members had fled the scene.

The man that was attacked was hospitalised with broken ribs but is expected to recover from his serious injuries. The woman’s injuries were treated at the hospital and she was able to return home to care for her children.

Police are conducing inquiries to identify the gang of men whom are still at large in the community.

Keypoints:

There was an immediate and grievous danger to the family;

The family were within the property lines of their home;

There appeared to be no other “preservation of life” option other than to intervene;

The armed gang member on approach to the security officer was clearly warned that if he attacked he would be fired upon; and

It was prudent not to attempt to detain the gang of men and noting the registration of the car and the descriptions to provide the police this information was the best thing that could be done given the situation.

Note 2: It is a requirement of the quality control criteria that security firms both “for profit” and those that are “not-for-profit” have officers that have completed a high level of training in first aid.

Budding comedian Eurydice Dixon, 22, was raped and murdered while walking home through Princes Park in June last year. Jaymes Todd is appealing against his life sentence.
“What we’re seeing is an unusual course of events,” MacKillop Family Services CEO Dr. Robyn Miller told Sunrise.
Dr Miller previously helped the Victorian government frame policy around family violence and has been working in the field for three decades.
“Statistically, these random attacks from strangers are quite rare. What’s more common are attacks by intimate partners, family members, and acquaintances.”A growing number of experts are questioning the belief that gender inequality is the root cause of violence against women. They argue that poverty, mental health, and substance abuse are also important factors.

What is witch-hunt legislation?

The Witchcraft Act was a law passed by the Parliament of the Kingdom of Great Britain. Authorities viewed witchcraft and magic as illusory, treating it as a serious offense. The last person executed for witchcraft in Great Britain was in 1727. The keyword above is “illusory”.

Today it is legislation that contains no criminal intent as an element of an offense that targets anyone associated with a firearm real or otherwise that results in a criminal charge.

A good example of a “Witch-Hunt legislation” is the following situation:

Teenagers in New South Wales engaging in the sport of gel-blasters (i.e. a toy gun that propels soft gel harmless to people) are the targets of a criminal offense to be in possession of these toys. Some will say that the justification for this criminal law is that gel-blasters look like real guns.

However, it is reasonable to say that over time real guns now look like toys noting the use of plastics and Hollywood like add-ons including futurist stocks, scopes, and other devices. It has become difficult to tell a real gun from a toy gun, and the trend is that real guns will become more sci-fi looking in appearance.

if criminal intent is not an element of an offence than it is reasonable to say that it is “illusory” to presume that just because a person may be in possession of a firearm (real or otherwise) that they have criminal intent.

Another example of possession of a firearm (real or otherwise) that has no criminal intent is the fear of being raped. A woman is being stalked by a known rapist that is illusive to the resource-poor police. Being a person that grew up during the era when possession of a firearm in and of itself was not evil, she acquires a 22 rifle from the black market that she keeps hidden in her bedroom because she is familiar with this weapon and knows how to safely use it if need be?

One night the known rapist break in through her back door, and she retrieves the rifle and as he breaks down her bedroom door she stand across the room from him and points the rifle at him shouting, “I’ll shoot if you take one more step towards me.”

On seeing the armed woman the known rapist retreats into the street and crashes his car running a red light.

The police arrest the woman for possession of an illegal firearm and they arrest the man for breaking into her house. Under present laws who will the law punish most in the above scenario, the known rapist or the woman?

Regrettable the woman will receive the hardest penalty as the man’s actions fall short of attempted rape because he did not take that one more step.

Scenario

In areas where the police-to-citizen ratio is high compared to other areas, it can be said that there is a problem. Often these areas will have high fences and dogs for protection. Unfortunately, not all dog owners are responsible and attacks upon children and adults out for a walk do occur.

A school teacher suffered serious injuries in a terrifying attack by a pack of dogs. The Teacher broke a leg after jumping a storm wall on the esplanade to escape the dogs. The dogs savaged her causing serious wounds to her shoulder and a broken ankle. She was flown to Townsville emergency ward by helicopter.

Example of Specific Circumstances and use of Regulated Weapon:

A community teacher working in an area where dangerous dogs have been known to roam the streets completed training consistent with the security industry standard and was issued a permit to possess pepper spray for the purpose of self-defense.

The permit issue allowed her to carry the pepper spray in her purse as she walked to and from the school. Today she was harassed by a pack of dogs and was able to avoid being attacking by using the pepper spray. Council’s animal control officers are in the area looking for the dogs.

Regulated Weapon – Salt Handgun

Scenario

An attacker armed with a knife in a public area has stabbed or is threatening to stab people around them. Refusing to put down his weapon and continuing to move aggressively towards people some of which are elderly and unable to out-run the attacker, what do you do?

Perhaps the “salt handgun” could be the answer to avoid hand to hand confrontation?

Salt handgun

Chicago-based startup Salt has launched a crowdfunding campaign for a less-than-lethal weapon designed as an alternative to firearms for self-defense. The pneumatic pistol is designed to stop an attacker using an incapacitating powder that temporarily blinds them without the need to engage with the attacker in close and dangerous quarters.

The Salt is a CO₂-powered air-gun that fires hollow plastic spheres similar to paintballs, except that instead of paint, they are filled with a proprietary powder made of oleoresin capsicum and other ingredients. On impact, the spheres burst and a fine spray of the powder spreads around the target. This powder is extremely irritating – causing an intense burning sensations that temporarily blinds anyone who encounters it while making it difficult to breathe.

The makers say that the powder is stronger in many respects than those used by the military and law enforcement and is designed for maximum stopping power.

The effects last up to 50 minutes, though they begin to wear off after 15 to 30 minutes. Because it’s a dust, the Salt rounds can not only be used to shoot an assailant directly but can also lay down a cloud 4-5 feet in diameter that acts as a barrier against attack.

Note: In a city or large town the response time of police to high priority incidents such as the scenario above (as an average) has been 8 to 9 minutes which is fairly impressive. However, a lot can happen in 8 to 9 minutes.

In countries areas the response could be an hour away should the police be attending an incident for instance a serious car accident on the other side of their police district. As for remote areas, several hours if someone was able to notify them should they be in a mobile phone coverage area.

Often the passer-by or another present at the scene is the first responder.

Example of Specific Circumstances and use of Regulated Weapon:

The restaurant manager completed training consistent with the security industry standard and was issued a permit to possess the salt handgun for the purpose of self-defense.

The permit issue allowed the regulated weapon to be kept on the premises of the restaurant. The weapon was used by the manager as a deterrent to a man who entered the restaurant waving a large bladed knife yelling at a man sitting at a dining table, “Your dead you’re dead, I’m going to kill you, I am going to kill you.” After a tense standoff of several minutes the police arrived and arrested the would be attacker.
